These Terms of Use of the Faceter AI Agent (hereinafter – the Terms) govern the provision and use of the AI agent functionality integrated into the “Faceter” Software (hereinafter – the Software), the right to use which is granted under the License Agreement – Public Offer of Avalab LLC.
1.1. The Faceter AI Agent (hereinafter – the AI Agent) is an additional functionality of the Software and is provided by Avalab Limited Liability Company (hereinafter – the Company).
1.2. The use of the AI Agent is permitted only if the User holds a valid License for the “Faceter” Software and agrees to these Terms.
1.3. The AI Agent may operate through third-party messengers (including Telegram), as well as through built-in messaging tools within the Software interface.
1.4. These Terms constitute an integral supplement to the License Agreement – Public Offer published at https://faceter.cam/.
1.5. In the event of any inconsistency between these Terms and the License Agreement – Public Offer, the provisions of the License Agreement – Public Offer shall prevail.
2.1. The AI Agent is a software module interacting with the “Faceter” Software.
2.2. By enabling the AI Agent, the User grants it access to video data, audio data, and metadata processed within the Software.
2.3. The AI Agent may:
– analyze video recordings and detection events;
– generate textual descriptions of objects and events;
– generate reports upon the User’s request;
– send notifications via available communication channels;
– execute automatic commands initiated by the User related to camera and device functionality, within the implemented technical capabilities.
2.4. The AI Agent analyzes existing recordings and data obtained through the Software and may generate new textual materials based on such analysis.
3.1. The AI Agent may be provided in a test (beta) mode.
3.2. When provided in beta mode, the functionality may be limited by technical parameters, including processing capacity and request volume.
3.3. The Company may at any time modify the terms of provision of the AI Agent, including access procedures and scope of functionality, by publishing an updated version of these Terms on the website.
3.4. Functionality provided in beta mode may be modified and improved during operation.
4.1. When using the AI Agent, the following data may be processed:
– video recordings and video streams;
– detection events;
– User text requests;
– logs of interaction with the AI Agent.
4.2. The Company may store logs of requests and interactions with the AI Agent for the purposes of ensuring service operation, analytics, improvement of algorithms, and compliance with applicable law.
4.3. Personal data processing is carried out in accordance with the Privacy Policy and applicable data protection legislation.
5.1. The AI Agent is an auxiliary data processing tool and does not constitute a security system, alarm system, or crime prevention tool.
5.2. The Company does not guarantee absolute accuracy of object or event recognition, timeliness of notifications, or uninterrupted operation of third-party services used for interaction with the AI Agent.
5.3. The User independently makes decisions based on information received from the AI Agent and bears responsibility for the consequences of such decisions.
5.4. The Company shall not be liable for losses arising from:
– inaccurate recognition;
– failure to detect an event;
– incorrect interpretation of information;
– execution of automatic commands initiated by the User;
– disruptions in third-party platforms or communication channels.
6.1. When using the AI Agent through third-party messengers, the User additionally agrees to comply with the terms and conditions of the respective platforms.
6.2. The Company shall not be responsible for the operation of third-party services through which interaction with the AI Agent is performed.
7.1. The User agrees to use the AI Agent solely for lawful purposes and only in relation to video cameras installed on lawful grounds.
7.2. The User bears sole responsibility for compliance with applicable laws in connection with the installation and use of video surveillance equipment.
7.3. The use of the AI Agent is prohibited for:
– unlawful surveillance;
– violation of third-party rights;
– circumvention of Software functionality restrictions.
8.1. Use of the AI Agent is permitted only by individuals having full legal capacity in accordance with applicable law.
9.1. The Company may suspend or terminate access to the AI Agent in the event of:
– violation of these Terms;
– violation of the License Agreement – Public Offer;
– unlawful use;
– technical necessity.
10.1. The Company may amend these Terms unilaterally by publishing an updated version on the website https://faceter.cam/.
10.2. Continued use of the AI Agent after publication of amendments constitutes acceptance of the updated Terms.
